A divorce is also referred to as
a dissolution, and it is one solution to the breakdown of
a marriage. Most people use
the word separation interchangeably with divorce. Legally,
however, they mean two different things. Couples who separate
remain married pending any further action, while those who
divorce are officially no longer married. How the couple’s
assets and debts are divided during a period of separation
varies by state and the type of separation that occurs.
The process begins with a Petition and a Summons which are
filed with the court system in the county where one resides.
After filing, the documents are forwarded to a Special Process
Server and served upon the spouse where he or she resides,
or at their place of business; this process can take approximately
3-7 days. The many steps that follow in the divorce proceeding,
such as discovery and negotiations, become the responsibility
of your Attorney.
The Law Offices of Benedict Schwarz, II will coordinate and
handle your case with the utmost care and professionalism,
throughout the entire process of dissolution, including but
not limited to the division of marital assets, child custody,
child support, parenting time, and marital support/alimony.
These issues can be determined by both parties agreeing to
a settlement or if that is not possible, the issues are then
brought to the court system for a judicial decision. We encourage
our clients to choose the settlement path, which is considerably
less costly and more expedient in achieving the final divorce/dissolution.
If our client is not in agreement with their mutual spouse,
we will then provide them with the legal guidance and expertise,
under the Illinois Divorce Laws, necessary to obtain decisions
and settlements decided by the courts.
Our firm handles cases with few assets, cases with modest
assets, as well as cases with considerable financial assets.
Our Attorneys are well equipped in handling cases that involve
out-of-court settlements or cases that necessitate a trial
and decisions made by the judicial system. We draw upon over
40 years of experience in Family Law to achieve the results
that are in the best interest of our clients and their families.

Alimony/Spousal Support/Maintenance
Alimony, Spousal Support, or Maintenance, represents regular
payments made from one spouse to the other during a separation
or after a divorce. The amount paid by one spouse to the other
will be set forth in a Court Order or the Marriage Settlement
Agreement. Sometimes there will be a fixed date when the support
ends and if not, it is usually not expected that the payment
will continue for life. In order to alter such an arrangement,
you must petition the court for a change.
